Tax Benefits
High-earning, busy professionals face substantial tax burdens, and investment income is on that list as well. Building your wealth efficiently also means finding ways to reduce taxable income. Real estate syndication can offer a practical way to achieve tax advantages that are often overlooked in traditional investment portfolios.
At Tempo Investments, we specialize in helping high-net-worth individuals build tax-efficient real estate portfolios through various strategies that leverage tax benefits for syndications.
Tax Advantages of Real Estate Syndication
Real estate syndication can offer several tax benefits, making it an attractive investment for professionals looking to maximize tax deductions.
Depreciation
Depreciation is one of the most significant benefits for reducing taxable income from real estate investments. Investors can deduct a portion of the property's value each year as a depreciation expense, even if the property is increasing in value. This noncash deduction helps lower the amount of taxable rental income generated by the property from the syndication, which reduces your overall tax liability.
Recent tax laws have allowed investors to benefit from bonus depreciation. Through this passive income tax strategy, a large portion of the property's value can be depreciated in the year it is placed into service rather than over the asset's useful life
Cost Segregation
The cost segregation strategy involves accelerating depreciation deductions. Instead of depreciating an entire property over a long period, which could be 39 years for commercial real estate, cost segregation breaks down components of the property.
It allows investors to identify and reclassify specific portions that have a shorter depreciation period and depreciate them over five, seven or 15 years. The result is larger depreciation deductions in the early years of ownership.
Pass-Through Deductions
Real estate syndication investments are typically structured as pass-through entities, like LLCs and limited partnerships. This structure means that the income, losses, deductions and credits from the syndication pass through directly to the individual investors' tax returns via Schedule K-1 forms.
As the investor, you avoid double taxation at both the corporate and individual levels, making syndications tax-advantaged passive-income investments.
Lower Tax Rate on Capital Gains
Another high-net-worth investment tax strategy focuses on capital gains, which are profits from the sale of property. Capital gains are treated as income, but the tax rates are lower than those for regular income. When a syndicated property is eventually sold, and it's been held for over a year, investors typically benefit from long-term capital gains tax rates.
Lazy 1031 Exchange
A 1031 exchange is an IRS provision that allows investors to delay capital gains taxes when selling one investment property and putting the money back into a similar "like-kind" property. While typically applied to direct real estate ownership, syndications can facilitate these exchanges through the Lazy 1031 approach.
This strategy allows you, as an investor in a real estate syndication, to defer capital gains by reinvesting the sale proceeds from a liquidated syndication into a new, pre-identified syndicated property in the same tax year, thereby maximizing depreciation benefits.
